PERSONAL INFORMATION

Definition of Personal Information: Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) defines personal information as information about an identifiable individual (the “Personal Information”), and includes information about personal characteristics (e.g. sex, gender, age, name, income, ethnic background, home address, and family status); health (e.g. health history, health conditions, and health services received); and personal beliefs and views (e.g. religion, politics, opinions expressed by an individual, and an opinion or evaluation of an individual).

Collecting, Using, and Disclosing Personal Information

Like all regulated health care professionals, the Registered Dietitians with Dayna Zarn will collect, use, and disclose your Personal Information in order to serve you and provide you with dietetic services, the Services, and the Offerings through the Site.  We collect your health information for the purposes described in this Privacy Policy, including in order to assess what your health needs are, and to advise you of your options, and then provide the dietetic counseling, Services, or Offering you choose to receive from us.  This may include referring and coordinating care with other healthcare professionals (e.g. your family doctor, psychologist, chiropractor, and other healthcare professionals). Any healthcare professionals I conduct business with are also bound by the same privacy practices.  Additionally, among other purposes, we also collect Personal Information to schedule appointments, for billing purposes, and customer services.

Collecting Your Personal Information:

We may collect Personal Information about you in a variety of ways. The Personal Information we may collect on the Site includes:

a) Personal Data: Personally identifiable information, such as your name, shipping address, email address, and telephone number, and demographic information that you provide us which is not unique to you, such as your postal code, age, gender, the identity and contact information of your organization, and/or your organization’s employees, which you voluntarily give to us to enable you to use features of the Site, the Offerings, and the Services.  

b) Usage Information: Usage information, including the information created from your use of the Services, the Offerings, and Site including metadata generated from and location information regarding your use of the Site and log data recording when you have used the Site.  

c) Financial Data: Financial information, such as data related to your payment method (e.g. valid credit card number, card brand, expiration date) that we may collect when you purchase, order, return, exchange, or request information about our Offerings and Services from the Site.  In completing transactions for products and services with Us, the following Personal Information could be collected from you: (i) billing information such as the number, expiration date, card type and billing address of your credit card; and (ii) demographic information such as a company name or type, job title and job description.  We store only very limited, if any, financial information that we collect. Otherwise, all financial information is stored by our payment processor, Amazon Payments, Stripe, Square, and Third-Party payment options, and you are encouraged to review their privacy policy and contact them directly for responses to your questions.  

d) Social Networking Data: We may access personal information from social networking sites and apps, including Facebook, Instagram, LinkedIn, Twitter, Snapchat or other social networking sites or apps not named specifically here, which may include Your name, Your social network username, location, email address, age, gender, profile picture and any public information available through Your accounts on social media networking sites and apps. If You do not want Us to access this information, please go to the specific social networking site and change Your privacy settings.  

e) Newsletter Information: We may access information that you provide to us for the purpose of subscribing to newsletters, obtaining or receiving updates about new products, promotions and services, and/or obtaining or receiving notifications, including e-mail notifications.  

f) Mobile Device Data: Device information, such as your mobile device ID, model, and manufacturer, and information about the location of your device, if you access the Site from a mobile device.  

g) Third-Party Data: Information from third parties, such as personal information or network friends, if you connect your account to the third party and grant the Site permission to access this information.

Dayna Zarn only collects such Personal Information as is reasonably necessary for Us to fulfill the purposes as set out in this Privacy Policy, including Personal Information that is relevant to the legitimate purposes of the Site and to enable Us to provide the Services and Offerings and do business with you.

With respect to the Personal Information of any third parties that you may provide to Us in connection with your use of the Site and/or the Services, we will protect such Personal Information against unauthorized access, use or disclosure. However, you are responsible for ensuring that you have any such third party’s consent to the collection, use and disclosure of their Personal Information in accordance with the terms of this Privacy Policy, and you hereby represent and warrant that you have such consent.

You acknowledge and agree that your Personal Information may be uploaded, moved, stored, processed in, backed up and/or transferred in our discretion in jurisdictions other than Canada, including the United States, and you consent to the same. You also acknowledge and agree that your Personal Information may be transmitted, uploaded, or moved across international borders in our discretion, and you consent to the same.

Disclosing Your Personal Information

Any Personal Information provided by you, or that is derived automatically by or through the Site, the Offerings, and/or the Services, is not sold, rented, or shared by us with any third party without your consent, except in the circumstances described in this Privacy Policy.

We may disclose your Personal Information to any of our employees, officers, insurers, professional advisers, agents, suppliers or subcontractors, to the extent that such disclosure is reasonably necessary for the purposes set out in this Privacy Policy.

You acknowledge and agree that We may use and/or disclose your Personal Information, without notice, if legally permitted to do so according to the relevant provisions of the Canada Personal Information Protection and Electronic Documents Act, S.C. 2000, c.5 and the Personal Information Protection Act, S.A. 2003, c. P-6.5, and/or any other relevant privacy enactment (collectively, the “Privacy Acts”).  The Privacy Acts may permit the use and/or disclosure of Personal Information without notice if, for example: (a) the Personal Information could be useful in the investigation of a contravention of the laws of Canada, a province or a foreign jurisdiction; (b) the Personal Information is used or disclosed for the purpose of acting in respect of an emergency that threatens the life, health or security of an individual; and (c) the Personal Information is disclosed to comply with the edicts of the law, or to comply with a subpoena or warrant issued or an order made by a court. 

In any event, we may share information we have collected about you in certain situations. Your information may be disclosed as follows:

a) By Law or to Protect Rights: To comply with any law, order, rule, or regulation. If we believe the release of information about you is necessary to respond to legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property (including intellectual property rights), and safety of Us, our users or customers, or others, we may share your information as permitted or required by any applicable law, rule, or regulation. This includes exchanging information with other entities for fraud protection and credit risk reduction.  

b) Terms and Conditions: To enforce the Terms and Conditions of Use, and other policies of Dayna Zarn or other agreements between us.  

c) Third-Party Service Providers: We may share your information with third parties that perform services for us or on our behalf, including payment processing, data analysis, email delivery, hosting services, customer service, and marketing assistance.  One or more outside credit card processing companies may be used by Us to bill you for the Offerings and Services. We make every effort to ensure any company with which we may share Personal Information protects that data in a manner similar to this Privacy Policy and to limit the use of such Personal Information to the performance of the services being provided to Us.  

d) Marketing Communications: We may share your information with third parties for marketing purposes, as permitted by law.  

e) Business Partners: We may share your information with our business partners to offer you certain products, services or promotions.  

f) Other Third Parties: We may share your information with advertisers and investors for the purpose of conducting general business analysis. We may also share your information with such third parties for marketing purposes, as permitted by law.  

g) Sale or Bankruptcy: If we reorganize or sell all or a portion of our assets, undergo a merger, or are acquired by another entity, your Personal Information will be treated as a business asset and we may transfer your information to the successor entity. If we go out of business or enter bankruptcy or we transfer assets relating to our business to another parry in our sole discretion, your information may be an asset transferred or acquired by a third party. You acknowledge that such transfers may occur. We are not responsible for the actions of third parties with whom you share personal or sensitive data, and we have no authority to manage or control third-party solicitations. If you no longer wish to receive correspondence, emails or other communications from third parties, you are responsible for contacting the third party directly.

Security of Your Personal Information

At Dayna Zarn, we take reasonable steps to protect Your Personal Information and data and keep Your Personal Information and data secure. Among other measures that we use to secure your Personal Information, paper information is either under supervision or secured in a locked or restricted area, electronic hardware is always either under supervision or secured in a locked or restricted area, passwords are used on all computers, laptops, and mobile devices, and personal information about clients are not posted to any social media site.  We use recognized online secure payment systems and implement generally accepted standards of security to protect against Personal Information loss or misuse. However, no security measure is foolproof, and no method of data transmission can be guaranteed against interception or misuse. We endeavour to take commercially reasonable precautions to prevent and minimize such risks in connection with your use of the Site, the Offerings, and Services, but we offer no (and hereby expressly disclaim any) guarantee, representation, warranty, or covenant of any kind that Personal Information you transmit to Us will remain secure.

Retention and Destruction of Personal Information

Dayna Zarn retains Personal Information for a certain time frame to ensure that we can answer any questions you may have about the Services provided by us and for business accountability to external regulatory bodies. The College of Dietitians of Alberta advises Registered Dietitians to retain client records for a minimum of ten years following the last service.

Personal Information shall not be kept by Dayna Zarn for any longer than is necessary for the purposes identified in this Privacy Policy. Personal Information that is no longer required to fulfil the purposes identified in this Privacy Policy will be destroyed, erased, or made anonymous. All paper files that contain personal information are shredded. Electronic information containing personal information is deleted. Without limiting the foregoing or the purposes for which We may retain Personal Information, We:

a)       will retain account information for legitimate business and legal purposes including all records related to Offerings licensed and purchased by users;  

b)      when possible, will restrict the retention of information to the shortest possible time period; and  

c)       may pseudonymize some information for ongoing retention without identifying features.

You may request that We delete Your Personal Information at any time. We will honor Your request to delete Your Personal Information, as described more fully below, unless We are required by law to retain access to the Personal Information.  However, note that We cannot control the retention policies of third parties.   If You wish to have any third parties, including those to whom We’ve transmitted Your Personal Information, delete that Personal Information, You will need to contact those third parties directly. You may request from Us a list of all third parties to whom We have transmitted Your Personal Information.

We may retain usage data (that is, data that is gathered by Us or third-party analytics companies for the purpose of analyzing the use of Our Site) as needed for internal analysis purposes. This type of data is usually retained for a shorter period of time than Personal Information, unless the data is necessary to improve the security or functionality of Our website or offerings, or We are legally obligated to retain the data for a longer period of time.

Accessing and Corrections to Your Personal Information

You may ask to access your Personal Information we have on record at any time. Dayna Zarn can help you identify what records we have about you and try to help you understand any information you do not understand.  You have the right to request a digital copy of the Personal Information that We hold about You.  If you wish to access your Personal Information and/or request a copy of the Personal Information that We hold about You, please send a request, identifying with reasonable specificity the Personal Information that you wish to access or copy, to hello@daynazarn.com.  If we cannot give you access, we will tell you within 30 days if possible, and if possible will tell you the reason why we cannot give you access.

If you believe there is a mistake in your Personal Information in our possession, you may ask for it to be corrected.  This applies to factual information, but not to any professional opinions formed. We may ask you to provide documentation that our files are wrong.  Where we agree that there is a mistake in our records relating to your Personal Information, we will make the correction and notify anyone to whom this information may apply to, of the correction.

CONSENT

By making any use of the Site, the Offerings, or the Services, you hereby consent to the collection, use and disclosure of your Personal Information as set out in this Privacy Policy, and acknowledge and agree that your Personal Information may be used by us in accordance with this Privacy Policy.

Withdrawal of your consent to the collection, use and/or disclosure of your Personal Information as set out in this Privacy Policy may result in the Services or the Offerings or certain aspects of the Services or the Offerings being unavailable to you. If you withdraw your consent to the collection, use and/or disclosure of your Personal Information as set out in this Privacy Policy, We reserve the right to limit your access or prevent you from accessing the Site, the Offerings, and/or the Services.

AUTOMATICALLY GATHERED INFORMATION

We receive and store certain types of computer information whenever you interact with our Site. TRACKING TECHNOLOGIES

Cookies, web beacons, pixels, log files, and other tracking technology

We may use cookies, web beacons, tracking pixels, and other tracking technologies on the Site to help customize the Site and improve your experience. When you access the Site, your Personal Information is not collected using tracking technology. Websites use cookies (small text files sent to Us by Your computer). Cookies also let us know whether you have registered with Dayna Zarn and enable us to relate your current usage of a website to prior usage of the website. Like many other websites, We make use of log files. These files merely log visitors to the Site – usually a standard procedure for hosting companies and a part of hosting services’ analytics. The information inside the log files includes internet protocol (IP) addresses, browser type, Internet Service Provider (ISP), date/time stamp, referring/exit pages, and possibly the number of clicks. EMAIL

Using Personal Email: Transmitting Personal Information and data, including personal health information, via email poses several risks you should be aware of. Dayna Zarn uses reasonable means to protect the security and confidentiality of email information but cannot guarantee the security and confidentiality of email communications.  You should not communicate with Us via email without understanding and accepting these risks.

These risks include, but are not limited to the following: employers and online services may have a legal right to inspect emails that pass through their system; email is easier to falsify than handwritten or signed hard copies; emails can introduce viruses into a computer system and could potentially damage or disrupt the computer; email can be forwarded, intercepted, circulated, stored or even changed without the knowledge or permission of the sender or recipients; email senders can easily misaddress an email resulting in it being sent to one or more unintended and unknown recipients; and email cannot be readily erased or shredded (i.e., even when deleted by both sender and recipient, backup copies may exist on a computer or in cyberspace); and use of email to discuss sensitive information can increase the risk of such information being disclosed to third parties.

By expressly or impliedly indicating that you consent to communicating with us via email, including by sending or transmitting any information to Us via e-mail, in connection with your use of the Site, the Offerings, and the Services, you thereby agree to the following conditions:

  • any emails concerning your treatment will be kept by us as part of your clinical record;

  • if an email you send to Dayna Zarn requires a response and you have not received a response within a reasonable time frame, it is your responsibility to follow up to determine whether the intended recipient received the email and when you can expect a response; and

  • Dayna Zarn is not responsible for information lost due to technical failures associated with a client’s email software or internet service provider.

Email Confirmations: We may receive email confirmations when You open an email from Us. This allows Us to determine if users are responding favorably to Our email communications and to improve those communications.

Emails and Communications: You may opt out of receiving future email correspondence from Us or You may change Your communication settings, by contacting Us at hello@daynazarn.com.

We may partner with third party analytic companies, including Google Analytics. Client and customer data outside Canada may be transferred to Our website servers and/or third-party processors or subcontractors that are located in Canada.
